Department of Home Affairs (DHA) NIV Visa Requirements

Before applying for state nomination, applicants must first ensure they meet the baseline criteria set by the Department of Home Affairs. To apply for the National Innovation Visa (NIV) (Subclass 858), you must:

  • Be located offshore, or onshore holding a substantive visa or an eligible bridging visa. Have an internationally recognised record of exceptional and outstanding achievement in one of the following areas:
    • A profession
    • A sport
    • The arts
    • Academia and research
  • Be of any age. However, applicants under 18 or aged 55 and over must demonstrate that they would be of exceptional benefit to the Australian community.
  • Meet all other DHA eligibility criteria, including having an eligible nominator.

South Australia NIV Nomination Categories

To be considered for South Australian state nomination, your high-calibre talent and achievements must directly contribute to the South Australian economy. South Australia assesses Registration of Interest (ROI) applications under five distinct nomination categories:

1. Global Researchers and Thought Leaders

This category is designed for leading academics and researchers. Your achievements may be demonstrated by:

  • Receiving a national research grant in Australia or overseas.
  • Undertaking recent keynote appearances at high-profile international conferences.
  • Holding recognised intellectual property, such as international patents.
  • Current earnings or a job offer in South Australia at or above the Fair Work High Income Threshold (FWHIT).
  • Holding a PhD with high levels of academic influence, evidenced by:
    • Recent publications in top-ranked academic journals.
    • A high h-index for your career stage.
    • A research-based degree from a top 100 global university (e.g., Times Higher Education World University Rankings).

2. Entrepreneurs

For innovators looking to launch or expand a business in South Australia. You must provide evidence that your activities will lead to the commercialisation of a product or service in SA, or the development of an enterprise that significantly adds value to the local economy.

Requirements include:

  • In-depth knowledge, expertise, or a track record in the target product/service and its application in SA.
  • A strong commitment to launching an innovative, sustainable, high-growth start-up that creates jobs for South Australians.
  • Ensuring that the majority of project development, business assets, and staff will be based in South Australia.
  • (Note: There is no minimum investment threshold required for this category).

3. Innovative Investors

For investors who provide capital to innovative ecosystems, helping SA businesses bring new products to market and drive productivity. You must demonstrate an established track record of:

  • Supporting successful innovative ventures; OR
  • Leading internationally reputed companies to their Initial Public Offering (IPO).

Key conditions:

  • Investing into managed funds is only considered on an exceptional basis (requiring proof of significant past economic benefits to SA and a future SA investment strategy).
  • Traditional investment activities (e.g., cafes, retail, franchises, real estate, rental management, consulting) are not considered "innovative" for the purposes of SA state nomination.

(Note: There is no minimum investment threshold required for this category).

4. Creative Talent

Applicants must demonstrate significant achievements in their creative field, backed by international-level awards or globally recognised achievements.

5. Other Globally Talented Individuals

Highly skilled individuals who do not fit neatly into the above categories may be considered on a case-by-case basis. You will still need to demonstrate significant, internationally recognised achievements and awards in your respective field.

The South Australia NIV Application Process

Similar to the NSW nomination process, South Australia utilises a Registration of Interest (ROI) system. Securing a National Innovation Visa (NIV) (Subclass 858) through South Australia involves a multi-step process:

  1. Registration of Interest (ROI): Submit an ROI through the South Australian Skilled and Business Migration portal with all required documentation.
  2. Panel Interview: If your ROI progresses to the next stage, a Skilled and Business Migration officer will contact you. You will be required to attend an interview with an assessment panel of South Australian Government representatives.
  3. State Nomination Approval: Successful applicants will receive a completed Form 1000 and a business case letter from the state.
  4. Expression of Interest (EOI): You must then lodge your EOI with the Department of Home Affairs, submitting your SA state endorsement documents.
  5. Visa Invitation: Once invited by the Department of Home Affairs, you may lodge your official application for the National Innovation Visa.
